Commencement of operations of Anti-Dumping Commission - 1 July 2013

A. Anti-Dumping Commission commences operations

 

The following email is to advise stakeholders that the new Anti-Dumping Commission (Commission) within the Australian Customs and Border Protection Service (ACBPS) commences operations on 1 July 2013. The Commission will administer Australia's anti-dumping system and implement a program of reform in line with Australia's World Trade Organization obligations. As you are aware, these functions were previously undertaken by the International Trade Remedies Branch (ITRB).

 

The establishment of the Commission was the primary recommendation of the Brumby Review, and demonstrates the Government's commitment to strengthening Australia's anti-dumping system. Legislation to establish the Commission, headed by a statutory Anti-Dumping Commissioner (Commissioner) was passed in the Parliament on 14 March 2013.

 

The Commission will be located in a new office in Melbourne and will continue to maintain an office in Canberra. The Commission's new Melbourne office will be located in Customs House, Docklands Melbourne. The Commission will have an operational presence in both offices.

 

For your reference, please find attached Australian Customs Dumping Notice (ACDN) No. 2013/53 which provides further details in relation to the commencement of the Commission, including on:

 

·         the Commissioner's position;

·         the Commission's operations, specifically;

o    the locations of the Commission's offices;

o    the new Client Engagement and Business Support section;

o    enhancing the International Trade Remedies Advisory Service;

o    a new website for the Commission (which will "go live" on 1 July 2013 at www.adcommission.gov.au) and updating of ITRB materials;

·         new anti-dumping application forms and guidelines for applicants; and

·         a new import data assistance program.

 

B. Impact on on-going dumping and / or countervailing investigations and inquiries

 

The commencement of the Commission will not impact any on-going investigations and inquiries and will not result in increased investigation / inquiry timeframes. There will be no changes to Operations teams or Delegates / Case Managers involved in on-going investigations and inquiries.

 

C. Access to Australian Bureau of Statistics import data to assist potential applicants

 

From 1 July 2013, a new import data assistance program will be administered by the Commission to increase access to Australian Bureau of Statistics (ABS) import data for potential applicants seeking the imposition of anti-dumping measures. Australian industry members with a bona fide intention of lodging a dumping and / or countervailing application will be eligible to apply to the Commission to obtain relevant import data from the ABS on their behalf, and at no cost to approved applicants. Please refer to the attached ACDN for more information and please note that further information will be available on the Commission's new website shortly.
