Did you hear the one about ...
(a) The first time importer who purchased a vehicle in the USA;
(b) A shipping line with offices in Australia accepted the cargo and issued a bill of lading;
(c) Importer did not receive arrival notice or other correspondence from the line but contacted the line several times after the ship arrived to ask about their cargo, only to be told that the line had no record of the cargo;
(d) 10 days after the cargo arrived the line phoned the importer and demanded that their invoice be paid;
(e) Importer said had not received invoice or arrival notice and referred to the fruitless conversations he had with the line;
(f) The line could not provide copies of email correspondence they said they had sent the importer but demanded he pay $700.00 per day wharf storage before they would release the cargo.
Our suggestion:
Document any discussions regarding cargo delivery or availablity issues by sending the party who cannot perform their oligations to locate and release cargo in a timely fashion in an email confirming the terms of the discussion. This should protect your compay or your clients from paying wharf storage charges for which they are not responsible
