Australian Consumer Law update - Senate passes unfair contracts laws

The Senate today passed the Australian Consumer Law Bill 2009 (Bill). The Bill contains the Unfair Contracts laws with minor proposed amendments, which we have described in previous e’Alerts. The amended Bill must now be returned to the House of Representatives for the amendments to be ratified.

It is not currently known if the House will have time to consider the amendments before the end of the current sitting tomorrow, Thursday 18 March. After the current sitting, Parliament does not sit again until the Budget in May. It is therefore not possible to know yet whether the new Unfair Contracts laws will commence on 1 July as the Government had hoped, or whether the commencement will have to be further delayed.

The Government today also introduced its second tranche of Australian Consumer Law changes to the Trade Practices Act to parliament. We are currently reviewing that Bill and will prepare an e'Alert summarising the proposals shortly.
