Avoidance of
contractual obligations – when can you bring a contract to an end?
There is no prohibition on seeking to renegotiate the terms of a
long-term contract in light of changing market conditions. However, a party
seeking to renegotiate must be careful not to inadvertently find itself in
repudiatory breach of the contract.
New regime at
Sydney Ports
On 29 April 2010 the NSW Government announced that it will be rolling
out a new landside cargo management regime in an attempt to ease congestion
at Sydney’s container terminals.

The Personal Property
Securities Act 2009 and the Personal
Property Securities (Consequential Amendments) Act 2009 (“PPS”)
are due to commence on 1 May 2011. While this may seem a long way off, you
need to start thinking about how the new law will impact your business and
start preparing now for the changes.
