The Trade
Practices Amendment (Australian Consumer Law) Bill 2009 was
introduced to the House of Representatives today. Among other changes,
this Bill introduces the Government's proposed national unfair contracts
regime. The Bill has
been amended from the exposure draft so that, for the moment at least, business
to business contracts are exempted. The unfair contract provisions are
instead limited to “consumer contracts”. These are defined as contracts for
the supply of goods and services (or an interest in land) to an individual
whose acquisition of the goods services or interest is wholly or
predominantly for personal, domestic or household use or consumption. The Minister's
press release is attached. We will
prepare and distribute a summary of the new Bill and other provisions it
contains shortly. |
